§ 1 Scope

These Terms and Conditions (T&Cs) apply to all contracts between checkdenwagen Automobile DE (hereinafter "we" or "Check den Wagen") and the customer (hereinafter "you") concerning the provision of services relating to used-car inspections. Any deviating terms set by the customer are not recognised unless we expressly agree to their validity in writing.

§ 2 Scope of Services

We offer used-car inspections as a service. The specific scope is determined by the package you book (e.g. Standard Check, Premium Check). The inspection takes place on-site where the vehicle is located. Travel costs are calculated based on the postcode and shown transparently before you complete your booking.

• Visual and technical inspection
• OBD fault-memory readout
• Paint-thickness measurement
• Digital inspection report with photos

The inspection does not replace a full TÜV main inspection (HU) or a court-admissible expert appraisal.

§ 3 Conclusion of Contract

The contract is concluded as soon as you have submitted the fully completed booking form and successfully completed payment via Stripe. You will then receive a booking confirmation by email. We take care of coordinating the appointment with the vehicle seller.

§ 4 Prices and Payment Terms

The prices shown on the website at the time of booking apply, including statutory VAT. Payment is made by credit card / SEPA / other methods offered via Stripe directly at the time of booking. You will receive the invoice by email after the inspection has been carried out.

§ 5 Scheduling and Cancellation

If no appointment can be arranged with the seller, we will refund the full amount. If you cancel an already scheduled appointment less than 24 hours in advance, or if the seller does not show up, we reserve the right to charge a cancellation fee of up to 50% of the order value.

§ 6 Right of Withdrawal for Consumers

As a consumer, you generally have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract was concluded. To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. by email to info@checkdenwagen.de).

Expiry of the Right of Withdrawal

In the case of a contract for the provision of services, the right of withdrawal expires early if we have fully performed the service and you have expressly consented to the performance beginning and at the same time confirmed that you are aware your right of withdrawal expires upon complete fulfilment of the contract (§ 356 para. 4 BGB). By booking and expressly consenting to the immediate scheduling of the appointment, you confirm this.

§ 7 Warranty and Liability

We provide our services with the diligence of a prudent business person. The inspection report is a snapshot at the time of the inspection and is based on the non-destructive checks carried out on-site. Defects that are not detectable within the agreed depth of inspection (e.g. hidden engine damage without a fault-memory entry) are not covered by the scope of services.

We are liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, body or health. In the case of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations), and then limited to the foreseeable, contract-typical damage at the time the contract was concluded.

§ 8 Data Protection

§ 9 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, where legally permissible, Berlin. Should individual provisions of these T&Cs be or become invalid, this shall not affect the validity of the remaining provisions.
